3 Allgemeines zur Datenverarbeitung
Wir verarbeiten personenbezogene Daten unserer Nutzer grundsätzlich nur, soweit dies zur Bereitstellung einer funktionsfähigen Website sowie unserer Inhalte und Leistungen erforderlich ist. Die Verarbeitung personenbezogener Daten unserer Nutzer erfolgt regelmäßig nur nach Einwilligung des Nutzers. Eine Ausnahme gilt in solchen Fällen, in denen eine vorherige Einholung einer Einwilligung aus tatsächlichen Gründen nicht möglich ist und die Verarbeitung der Daten durch gesetzliche Vorschriften gestattet ist.

Mit dem Besuch unserer Webseiten werden von uns automatisch verschiedene Informationen in den jeweiligen Server-Logfiles erfasst. Hierzu gehören beispielsweise die Art und die Versionsnummer Ihres Webbrowsers, Ihr verwendetes Betriebssystem, Informationen zu
Ihrem verwendeten Internetprovider, Ihre IP-Adresse, Datum und Uhrzeit des Zugriffs und andere ähnliche Informationen. Diese Informationen fallen systembedingt bei der Nutzung des Internets an und sind daher technisch zwingend notwendig, um einen einwandfreien, reibungslosen und sicheren Betrieb einer Webseite zu gewährleisten. Die Logfiles enthalten IP-Adressen oder sonstige Daten, die eine Zuordnung zu einem Nutzer ermöglichen. Eine Speicherung dieser Daten zusammen mit anderen personenbezogenen Daten des Nutzers findet nicht statt. Nach 14 Tagen werden diese Serverlogs, die u.a. strikt getrennt von den restlichen Daten vorgehalten werden, endgültig gelöscht.
Rechtsgrundlage für die vorübergehende Speicherung der Daten und der Logfiles ist erforderlich zur Wahrung eines berechtigten Interesses unseres Unternehmens oder eines Dritten und überwiegt somit die Interessen, Grundrechte und Grundfreiheiten des Betroffenen; mithin dient Art. 6 Abs. 1 lit. f DSGVO als Rechtsgrundlage für die Verarbeitung. Gleichzeitig werden diese so gewonnenen Daten u.a. im Rahmen von statistischen Auswertungen hinsichtlich der Optimierung und der Sicherheit unseres Internetauftritts verwendet. Auch hier liegt ein berechtigtes Interesse unseres Unternehmens vor und es überwiegen auch hier wiederum die Interessen, Grundrechte und Grundfreiheiten des Betroffenen nicht gegenüber dem erstgenannten Interesse. Mithin dient Art. 6 Abs. 1 lit. f DSGVO als Rechtsgrundlage für diese Verarbeitung.
4 Cookies
"Persistente Cookies" oder auch "permanente Cookies" hingegen speichern anonyme Informationen auf dem jeweiligen Gerät und stehen auch nach dem Schließen des Browsers weiterhin zur Verfügung. Jedes dieser Cookies ist mit einem entsprechenden "Verfalls"-/Gültigkeitsdatum versehen, zu dem dann dieses Cookie automatisch gelöscht wird. Das Benutzerbild des Google-Accounts wird ebenfalls zur Accounterstellung des CHECK24 Kundenkontos verwendet. Ist kein Benutzerfoto im Google-Account hinterlegt, wird diese Information folgerichtig auch nicht für das CHECK24 Benutzerkonto verwendet.
App Aktivitäten
Grundsätzlich wird eine Nutzung der App gemessen. Dies passiert jedoch unabhängig von Nutzeraccounts

Nutzung des CHECK24 Kundenkontos
Durch die Nutzung des Kundenkontos wird zudem folgende Daten gesammelt, gespeichert und für die Produktabschlüsse verwendet

- Vorname, Nachname
- Straße, Hausnummer
- Land, Postleitzahl, Ort
- Telefon und Mobiltelefon
- Ihre E-Mail-Adresse
- Ihr Geburtsdatum
- Zahlungsdaten (IBAN, BIC, BLZ, Konto-Nummer, SEPA-Nummer, Bankname, Konto-Inhaber etc.)
- Token zum Abrufen von maskierten Kreditkartendaten (letzten 4 Stellen der Kreditkartennummer, Kreditkarteninhaber, Gültigkeitsdatum)
- PayPal Billing Agreement ID, mit der geprüft werden kann, ob der automatischen Händlerabbuchung zugestimmt wurde und mit der eine Zahlung über PayPal initiiert werden kann
Für die Nutzung des CHECK24 Kundenkontos gelten gesonderte Nutzungsbedingungen, die der Zustimmung der Nutzer bedürfen und hier eingesehen werden können.
Löschung von Kunden Daten
Der Benutzer kann die Funktion des Kundenkontos auf der Website oder in der App verwenden, um CHECK24 über Aktualisierungen, Änderungen oder Korrekturen seiner zuvor erfassten Informationen zu informieren. Darüber hinaus werden wir auf Anfrage des Nutzers alle angemessenen Anstrengungen unternehmen, um die Nutzerdaten aus unseren Datenbanken zu entfernen.
Löschung des Kundenkontos
Der Benutzer kann jederzeit eine Löschung seines Kundenkontos oder seine Daten beantragen. Hierfür muss lediglich eine E-Mail mit Wunsch auf Datenlöschung an datenschutz@check24.at gesendet werden. Zusätzlich können Kunden in der App oder Online selbst eine Löschung des Kontos bewirken.

Darüber hinaus können wir unabhängig davon in Einzelfällen Ihre personenbezogenen Daten verarbeiten, um Direktwerbung zu betreiben. Sie haben das Recht, jederzeit Widerspruch gegen die Verarbeitung Sie betreffender personenbezogener Daten zum Zwecke derartiger Werbung einzulegen; dies gilt auch für das Profiling, soweit es mit solcher Direktwerbung in Verbindung steht. 3 General information on data processing
As a matter of principle, we process personal data of our users only insofar as this is necessary for the provision of a functional website as well as our content and services. The processing of personal data of our users is regularly only carried out with the consent of the user. An exception applies in those cases where obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.
3.1 Purpose of processing and legal basis
At this point, we would like to explain our philosophy in dealing with personal data that you transmit to us when visiting our website, as well as provide some basic information on data protection. We respect the data protection rights of every individual. Our services are in accordance with the legal data protection provisions regulated in the EU General Data Protection Regulation (DSGVO), the German Federal Data Protection Act (BDSG), the German Telemedia Act (TMG) and the Unfair Competition Act (UWG).
As a matter of principle, we process personal data of our users only insofar as this is necessary for the provision of a functional website as well as our content and services. When you visit our websites, we automatically record various information in the respective server log files. Here, too, there is a legitimate interest of our company and again the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest. The collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object.
4 Cookies
"Persistent cookies" or also "permanent cookies", on the other hand, store anonymous information on the respective device and continue to be available even after closing the browser. Each of these cookies is provided with a corresponding "expiration" / validity date, at which time this cookie is then automatically deleted. 5 Tracking technologies

CHECK24 itself exclusively uses the so-called "DoubleClick Floodlight-Cookie" to measure the success of its online advertising campaigns. CHECK24 does not use any other tracking technologies. 5.2 DoubleClick floodlight cookie from Google
DoubleClick is a service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as "Google"). DoubleClick uses cookies (so-called "floodlights") to better and more accurately present you with relevant advertisements. 6 Social Login
6.1 Google Login
If you have a Google user account, you can also register and log in for our services using your Google credentials. Google's privacy policy and terms of use apply to registration with and use of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, which you can view at http://www.google.de/intl/de/policies/.
You can register or log in to our offer with the help of Google by clicking on the button marked with the Google logo as part of the registration process. You will then be redirected to Google. If you are already registered with Google at this time, Google will already know that you want to register for our services with the help of Google when you click on the button. If you are not logged in to Google at this time, Google will ask you to log in to Google by entering your access data or to register as a new Google user. In any case, the entry of your Google access data takes place directly on Google's server. We do not learn your Google access data.
Google then asks whether you would like to register for our services with the help of Google. Only if you actively agree to this, we receive your name, email address, profile picture and country from Google. We only store your name and email address in order to create your personal CHECK24 customer account or to update your existing one. All other information we receive from your Google user account is discarded.
If you use an email address for which you already have a personal CHECK24 customer account with password to log in with your Google user account, we will ask you to enter your CHECK24 password so that we can link your existing CHECK24 customer account with your Google user account. This way you will still have access to all your activities and benefits of your existing CHECK24 customer account.
If you decide to register or log in to CHECK24 with your Google credentials, Google will become aware of your request by clicking on the button marked with the Google logo. In addition, Google sets a cookie in your browser when you click on the button marked with the Google logo. By means of this text file, Google can collect further information about you and your surfing behavior. The information generated by the cookie is regularly transmitted to a Google server, which may be located in the USA. Image information
The user picture of the Google account is also used for the account creation of the CHECK24 customer account. If no user photo is stored in the Google account, this information is consequently not used for the CHECK24 user account.

Basically, a usage of the app is measured. However, this happens independently of user accounts

Use of the CHECK24 customer account
By using the customer account, the following data is also collected, stored and used for product transactions

- Your date of birth
- Payment data (IBAN, BIC, BLZ, account number, SEPA number, bank name, account holder, etc.)
- Token to retrieve masked credit card data (last 4 digits of credit card number, credit card holder, expiration date)
- PayPal Billing Agreement ID, which can be used to check whether the automatic merchant debit has been agreed to and which can be used to initiate a payment via PayPal

Deletion of customer data
The user may use the customer account function on the website or in the app to inform CHECK24 of any updates, changes or corrections to their previously recorded information. In addition, at the user's request, we will make every reasonable effort to remove the user data from our databases.
Deletion of the customer account
The user may request deletion of his/her customer account or data at any time. To do so, simply send an email requesting data deletion to datenschutz@check24.at. In addition, customers can cause a deletion of the account in the app or online itself.
7 Information about your right to object according to Art. 21 DSGVO
7.1 Individual Right of Objection
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6(1)(e) DSGVO (data processing in the public interest) and Art. 6(1)(f) DSGVO (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Art. 4 No. 4 DSGVO.
